Future of vaccine mandates? Amtrak and Boeing back down – for now

Mandates are probably unconstitutional, they throw a wrench in the works of business and our economy, AND they don’t work! So what’s the latest good news? Businesses are backing down.

Amtrak loosened its vaccination policy for employees Tuesday after warning last week that its earlier-planned mandate would prevent it from operating all of its scheduled passenger trains.

Amtrak said it would suspend its Covid-19 vaccine mandate for employees, a reversal from last week’s policy stance that the rail company said would allow it to operate its passenger trains as scheduled.

In a letter to employees Tuesday, Amtrak Chief Executive Bill Flynn said the company would allow weekly testing as an alternative to vaccination for workers who don’t have an approved accommodation.

“After reviewing our system service plans in light of these change, we do not anticipate having system-wide service impacts in January,” Mr. Flynn said in the letter. 

Amtrak had previously set a vaccine mandate to take effect Jan. 4, the same day that White House-issued vaccination requirements for federal contractors were scheduled to go into effect. But last week, the company said its planned mandate would prevent it from operating all of its scheduled passenger trains. . .

The company ultimately chose to permit weekly testing as an alternative, he said, adding that the revised policy would be in effect while President Biden’s executive order remains unenforced. Amtrak will continue to update its vaccine policy as needed, Mr. Flynn wrote.

Amtrak may reimpose the mandate, but we will see.

Boeing suspended its coronavirus vaccination requirement for U.S.-based employees, the U.S. planemaker said on Friday, capping weeks of uncertainty as thousands of workers sought exemptions and challenges to a federal mandate played out in court.

In an internal announcement, Boeing said its decision came after a review of a U.S. District Court ruling earlier this month that halted the enforcement of President Joe Biden’s vaccine requirement for federal contractors.

Some big healthcare chains and companies such as General Electric, Spirit AeroSystems, and Amtrak have also suspended vaccine mandates for workers.

Employers may reinstate vaccine mandates, as a Federal Appeals Court has reinstated the Biden administration vaccine and testing mandate. And so the nightmare continues.

A federal appeals court has reinstated the Biden administration’s vaccine and testing requirement for private businesses that covers about 80 million American workers.

The ruling by the 6th U.S. Court of Appeals in Cincinnati lifted a November injunction that had blocked the rule from the Occupational Safety and Health Administration, which applies to businesses with at least 100 workers.

 
In the decision Friday, the 6th Circuit noted that OSHA has historical precedent for using wide discretion to ensure worker safety and “demonstrated the pervasive danger that COVID-19 poses to workers—unvaccinated workers in particular—in their workplaces.”

    It’s one yuge scam and ALL of America has fallen for it! Ninety nine percent recovery and the vaxxed are the ones to carry it? Then blame the unvaxxed? I was born on a Sunday, but it sure as H3ll wasn’t last Sunday! On top of that believing the science is settled??? There sure are doctors that are retired that they can’t suspend their license saying different!

    Re: the Sixth Circuit decision – this lawsuit was a joke as explained by prob Robert Barnes but memory eludes at present where and how this was heard.
    Anyways, the “plaintiffs” went along with the OSHA mandate but argued the case on the specious “exemptions” that were being granted.

    If memory kicks in will put up a link, or perhaps someone else heard it?

    One of the reasons the illegals are not being vaccinated is b/c contrary to U.S. citizens, illegals are allowed to sue Big Pharma for damages, and we cannot have that now, can we?
    Heard this from RFK Jr on Bannon’s show this morning plus used deductive reasoning.

    I suppose going into the holiday season is not a good time to be experiencing a massive shortage of qualified passenger train operators. Could it be that some decision makers at Amtrak have started taking night school classes on the basics of how to run a successful business?

      I think it’s more likely the previous court decision that the mandate was not legal, but certainly the fact that they can’t properly operate the business without employees comes into it. They have left their options open, however.

    My concern with all of this is that if it gets to SCOTUS, which it will, if our side doesn’t “win”, there will be nothing the gov’t. cannot do to us.
