Should we ban Muslims from entering the United States?

(New York, NY) December 7th, 2015, –Donald J. Trump is calling for a total and complete shutdown of Muslims entering the United States until our country’s representatives can figure out what is going on. According to Pew Research, among others, there is great hatred towards Americans by large segments of the Muslim population. Most recently, a poll from the Center for Security Policy released data showing “25% of those polled agreed that violence against Americans here in the United States is justified as a part of the global jihad” and 51% of those polled, “agreed that Muslims in America should have the choice of being governed according to Shariah.” Shariah authorizes such atrocities as murder against non-believers who won’t convert, beheadings and more unthinkable acts that pose great harm to Americans, especially women.

Mr. Trump stated, “Without looking at the various polling data, it is obvious to anybody the hatred is beyond comprehension. Where this hatred comes from and why we will have to determine. Until we are able to determine and understand this problem and the dangerous threat it poses, our country cannot be the victims of horrendous attacks by people that believe only in Jihad, and have no sense of reason or respect for human life. If I win the election for President, we are going to Make America Great Again.” – Donald J. Trump

divider-line1Here is the Pew Poll that I believe Trump is referring to in his statement*.  It is called, “Muslim Americans”, and was conducted in 2006-2007.  Some of their findings:

26% believe Muslims coming to the U.S. should stay apart from u.s. society.

24% say it’s not okay for a Muslim to marry a non-Muslim.

50% say that the Koran is to be taken literally, word for word.

43% believe that mosques should speak out on political topics.

33% believe that there is only ONE true way to interpret the teachings of Islam.

47% think of themselves as Muslims first and Americans second.

10% are “not at all concerned” about the rise of Islamic extremism around the WORLD.

20% are “not at all concerned” about the rise of Islamic extremism in the U.S.

8% say it is “often” or “sometimes” justified to think that suicide bombing and other forms of violence against civilian targets are justified in order to defend Islam from its enemies.

28% don’t believe Arabs carried out the 9/11 attacks, and

7% believe it was the U.S. government/President Bush.

16% believe that Israel must not exist in order for Palestinian rights and needs to be taken care of.

5% are favorable or somewhat favorable to Al Qaeda.

divider-line1Another way of thinking about this was posited by Dennis Michael Lynch on Facebook this morning, and it makes a lot of sense to me:

MY TAKE: TRUMP’S BAN ON MUSLIMS

He wants the US to stop taking in Muslims. The politically correct media, the blind fools in DC, and the bleeding hearts who will vote for either Hillary or Bernie will say this proves Trump is a bigot who is unfit to lead. Meanwhile, the Trump faithful will agree with him 110%, and the lawyers will say his plan is against the law.

I say it’s refreshing to see him go against the grain, tell it like it is, and not give a damn what people think of him. That said, his newest plan is impossible, and being as smart as he is, he knows it can’t be done. Building a wall on the border and having Mexico pay for it is a stretch, but it is possible. But to block all Muslims from entering the US? He’d be better off trying to boil the ocean.

Logistically, operationally, economically, and legally his plan holds no water. Just one example: Imagine each day there being a line of 1,000 cars at the Canadian border trying to come over into the US. Each car carries 4 people. How will the Customs Officer determine who is and who is not a Muslim? Can you see all the problems that arise?

Although Trump’s plan is silly in the sense it cannot be accomplished, it doesn’t stem from hate or stupidity. It stems from a man who knows our national security isn’t what it needs to be. He knows we are at risk, and there is no reason why we are taking in so many people. He knows that most Muslims are law abiding, but that the risk of taking in a million people per year, many of them from countries we deem dangerous, causes us to miss the radical Muslims.

Trump is not a bigot. He isn’t anti-Muslim. He is pro- America. He says he wants to make America great again and I believe him. He is super smart, and he gets stuff done, but in the case of banning all Muslims he is jumping into the shallow end head first. I hope it doesn’t cause his own paralysis with the undecided voters who are all for national security, but can’t take him seriously about banning all Muslims and thus, don’t take him seriously at all.

I hope Trump reshapes his comments. The answer here is not a complete ban on all Muslims. The answer is to place an immediate moratorium on immigration from countries with a significant terror presence, such as Syria, Iraq, Iran and so on. In doing so not only would we limit the exposure to radical Muslims, but we’d limit immigration as a whole. Thus, our immigration system can catch its breath, and immigration officials don’t have to rubber stamp applications. Real background checks can be conducted.     I think we should have an immediate moratorium on ALL immigration for 25 years. We’re already broke and eaten up with illegals of all stripes.

      Today while driving home we were commenting on land that was for sale on the highway. I told the others in the car with me, “yay they can expand that housing addition to the highway.” That started a conversation of how it was getting to where seeing bare land was becoming a rarity around here. Then we all started talking about how eventually there wasn’t going to be any land left. One of the occupants said we were going to become China and have a one or two child limit. This was said in jest, but the truth is eventually we will be on top of each other.
      I know you can still travel parts of our state and not see a house for miles and I know it’s that way in other states, but not like it was even 20 years ago.
      So besides the fact that illegals are breaking us along with many of them we allow here legally such as Muslims who drain the system and besides the fact they are killing us, eventually we’re going to not have anywhere left to build houses to house everyone. We can’t make anymore land.
      States with vast amounts of open land are dwindling. Before long they’ll be telling us country folks we must open up our land to them.

      So I agree, until we get our house in order, we need to stop all immigration.

      Obama is one of those people who are often wrong but never in doubt.

      When terrorists are at war with us, we cannot simply declare that war to be over, whenever it is politically convenient, as Obama did when he withdrew American troops from Iraq, against the advice of his own generals. That is what led to the rise of ISIS.

      Our only real choice is between destroying ISIS over there or waiting for them to come over here and start killing Americans. As in other cases, Obama has made a choice that reflects politics and rhetoric, rather than reality.

    When i was processing through immigration and up until my citizenship the State Dept made it very clear that if i were outside the country during a crisis they held the decision to delay my re-entry for whatever reason. America is no stranger to refugees – we accept many from all over the world. The President is obfuscating the process and making it very difficult to accurately check people before they are cleared for entry. My own BC check examined my life back to age 17 – nearly 30 years at the time.
    Nobody’s talking about expulsion or extermination; just slow down the process. Austria and Hungary have both at times closed their borders for the same reason these last few months.
    The media is mostly opinion, lots of interpretation and a small amount of fact. Below is Trumps actual statement asking for a halt until we get clarity. I am not a particular Trump fan but there are plenty of people declaring a dislike – if not hatred – of America and Americans so it should be no surprise to find Americans responding to that.

    My immigration process was over 7 years duration and on the US Government schedule. I was forbidden entry even as a visitor until the first 7 months of my application process in my country of origin (UK) was complete. After arrival I was then not allowed out of the US for a further 18 months until the next stage of processing was complete. From the time I first set foot as an immigrant status I was guaranteed the protection of the US Constitution including the Bill of Rights except for the right to vote because I was not a citizen, and excluding the practical application of the 2nd because my State barred gun purchase as I was not a citizen.
    The goal for refugees would be to act speedier than that but checking needs to take place. The President is attempting to bypass that checking. That is a mistake.

      Good information. I have to say, after watching the video of the reporters following the father right up to his door, I would not have had the patience that he did. He was silent, and simply locked them out on his porch. Anybody I didn’t know followed me up to my door, at the very least I would tell them to get the hell off my property.

    Probably not. The Supreme Court has held consistently, for more than a century, that constitutional protections that normally benefit Americans and people on American territory do not apply when Congress decides who to admit and who to exclude as immigrants or other entrants. This is called the plenary power doctrine. The Court has repeatedly turned away challenges to immigration statutes and executive actions on grounds that they discriminate on the basis of race, national origin, and political belief, and that they deprive foreign nationals of due process protections. While the Court has not ruled on religious discrimination, it has also never given the slightest indication that religion would be exempt from the general rule.

    There is even precedent for Trump’s plan. In 1891, Congress passed a statute that made inadmissable people who practice polygamy (directed, at the time, at Mormons), and in 1907 extended this ban to people who “who admit their belief in the practice of polygamy.” While Congress later repealed the latter provision (the former seems to be still on the books), no court–as far I know–ruled it unconstitutional.

    The plenary power doctrine is universally loathed by scholars and some have argued that it is effectively a dead letter. But any honest answer to a journalist’s question about whether Trump’s plan to ban Muslim immigration is unconstitutional should start with the plenary powers doctrine, and observe that it would be an uphill battle to persuade the Supreme Court to abandon a century of precedent. Unfortunately, that is not what scholars–who certainly know better–are telling journalists. They are likely being abetted by journalists and headline writers who don’t like the idea that Trump’s ban would be lawful. Not everything that is stupid or offensive is unconstitutional.

    (N.B.: blocking American Muslims overseas from entering the country would certainly be unconstitutional, and blocking immigration by Muslims would raise complicated international-law questions.)

    Yes, we should ban Muslims from entering the US until we can thoroughly and effectively vet each and everyone.

    And if they cannot be vetted because of no paperwork or records etc. they should never be allowed in.

    ISIS has announced what they intend to do to the US, they intend to do the same thing as Al Quida did and that is to carry out terrorist attacks across America to murder and kill as many Americans as possible.

    Al Quida bombed the World Trade Center in 1993 and destroyed the WTC Twin Towers in 2001 killing thousands of Americans. The Islamic Muslim terrorist that carried out these attacks were welcomed into the US with open arms. This has to be stopped.!

    The Islamic Muslims (would be terrorist) seeking entry into our country already have a well established support base here in America by way of The Muslim Brotherhood and CAIR thanks to Obama, Hillary Clinton and their administration.

    Our so called leaders in Washington are not at all concerned about Americans safety. They are all talk and no action.! They continue to pursue their own self-interest and hidden agendas.

    So Yes, Trump is absolutely right – we should ban Muslims from entering the US until we can thoroughly and effectively vet each and everyone without exception.

    This is about security – Not racism. We need to be vigilant in every respect when it comes to Muslims.!

    Vote Trump 2016.!
