It sounds like Chief Justice Roberts is about to be stripped of any power in the Senate. I guess now I know why Schiff keeps begging for him to be a one man SCOTUS.

Here is the actual question Paul asked that I found on Breitbart:
Manager Schiff and Counsel for the President, are you aware that House Intelligence Committee staffer Shawn Misko had a close relationship with Eric Ciaramella when at the National Security Council together, and are you aware and how do you respond to reports that Ciaramella and Misko may have worked together to plot impeaching the President before there were formal House impeachment proceedings?”

So, they know this is the “whistleblower”?

Is the Chief Justice of the Supreme Court so stupid that he doesn’t understand by denying this question he just admitted that he knows one or both of these people are the whistleblower?

What I was told by a friend pretty high up in the political ranks:
Immediately after he denied to read Senator Paul’s question, Republican Senators phones lit up and have continued to be lit up. Senators have been shocked how many of their constituents are paying so close attention to every second of this trial.
One Senator apparently joked it’s making it harder for DNC employees to leave them vulgar messages.

4:50 PM THIS is the one and only pertinent question that was just asked:
“How can the Senate be accused of a cover-up if the Senate makes its decision on the same evidence the House did?” Mic drop……boom. Over and done as far as I am concerned. Immediate vote for aquittal.

Just heard that Collins and Romney say they are voting for witnesses. Alexander said he’s a no. So that leaves Murkowski who says she will have her decision in the morning. If she votes yes then that’s 50-50, unless a Democrat crosses over.

You know who breaks a tie in the senate.

      Romney is vile.

From what I’m reading nobody really knows the rules of this impeachment. VP Pence can’t break the tie.

Thanks Michelle I didn’t know this.

So the Chief Justice broke a tie in the past. Interesting.

Roberts is a turncoat bastard Bush loyalist.

Exactly, but I was thinking this morning that it wouldn’t be very smart for him to do so and I’m not sure he would want to. The fake Indian might have helped that cause along by her stupid question about him and SCOTUS.

If this charade is allowed and with his help as he already ticked off one side by refusing Sen. Paul’s question and if he went against Republicans and furthered this sham to drag out, guess who else could be impeached without breaking any laws?

Not to mention then if there is another tie on particular witnesses, some of which should require a court review over Executive Privilege then he would be making himself by all rights unjust to rule on due to his decisions in the Senate. If he recused himself or not then he would certainly weaken the SCOTUS.

Ok just thinking this though a little more, a tie should lawfully (if procedure is followed) end in favor of the measure not being passed as the senate does not have a majority of votes to further its agenda. The question being put forward is “Should we call witnesses?” They lawfully need a majority of votes to call witnesses, if they don’t have it the measure doesn’t pass so there is really no reason for a tie breaker.

It should be that way and like I pointed out above there are reasons for Roberts to refuse to do so that could personally harm him and the court.

Something else I was thinking about after reading Collins statement again is that some Democrats are not going to want witnesses. She said witnesses for both sides. Any and all witnesses POTUS wants would pass with the majority. The fear of Schiff, his staff, the Whistleblower, Bidens, IG, Vindman and an open door for team POTUS to get access to all of their records is enough for Schumer to give the nod to Democrat senators to vote against witnesses.
I think this is even more of a show that both sides are playing against us, McConnell and Schumer both want their talking points and fund raising.

My best understanding is that there is no written law as to what happens in the case of a tie.

Precedent is that the Chief Justice has broken ties.

I read a point of view which seems to be very reasonable, and legally sound, this is part of a process, the Senate has to have a majority of votes to demand witnesses. 50 is not a majority so the vote would fail and there would be no need for a tie breaker.

Thankfully it is a done point, regardless of law and facts, a tie would have been a nightmare scenario giving the democrats more time to showboat, lie and smear President Trump.

I remember her asking it and thought at the time that sounded like she would be voting no, but then she played the whole she wanted to think about it overnight.
I’m reading some talking about it on FB and there is actually some from Alabama saying they think Jones will vote against thinking it will get him elected and some from Arizona thinking Sinema will vote against, especially if it looks like there will be a tie.

Cruz seems to think they will have the votes.

Yep, I forgot about him. I heard someone today say that he was getting tons of pressure to vote against witnesses and convicting the President.

I read on FB someone called into C-Span today and said that the Democrat party should be ended. I thought that would be nice, we should force them to call themselves either the Communist party or Socialist Party, because that’s what they are and then force RINOS to join them. lol
