Baltimore officer Edward Nero found not guilty on all charges in Freddie Gray case

Justice prevails against mobocracy and a corrupt mayor.

DEVELOPING: A judge in Baltimore Monday found a police officer not guilty on all charges against him in connection with the death of Freddie Gray in police custody.

Officer Edward Nero faced second-degree assault, misconduct in office and reckless endangerment charges. Prosecutors said the 30-year-old unlawfully arrested Gray without probable cause and was negligent when he didn’t buckle the prisoner into a seat belt.

Nero opted for a bench trial rather than a jury trial. Baltimore Circuit Judge Barry Williams handed down the verdicts. Officer William Porter’s manslaughter trial ended with a hung jury.

    I am so pleased! Every officer should demand a bench trial. No judge is going to throw his or her career away for a corrupt mindless DA.

    To quote the late Antonin Scalia “Understand that reason is paramount with judges and that overt appeal to their emotions is resented. The reason is rooted in the nature of what we typically think of as “jury argument” — a blatant appeal to sympathy or other emotions, as opposed to logical application of the law to facts. Before judges such an appeal should be avoided.”

    A judge is no juror.

    Bravo! Nero! Bravo!

    As soon as I heard Nero chose a bench trial I predicted a full acquittal.

    THIS makes me angry. Got this off FOX. Mayor Stepanie Rawlings-Blake said, “This is our American system of justice and police officers must be afforded the same justice system as every other citizen in this city, state, and country. Now that the criminal case has come to an end, Officer Nero WILL FACE AN ADMINISTRATIVE REVIEW BY THE POLICE DEPARTMENT. We once again ask the citizens to be patient and to allow the entire process to come to a conclusion. In the case of any disturbance in the city, we are prepared to respond.”

    What makes me really angry is that they are going to continue this persecution. Grrrrr!

      I believe this is just her way of “saving face” and whipping up her supporters. I can’t imagine that the police union will tolerate unjust persecution of the officer.

        I think she is trying to keep the savages from burning the town down. I wonder how much property values have dropped, how many earners have left or are leaving Baltimore, after her “Give them room to riot” fanned the flames of destruction.

        Let’s see. The officers from NOPD’s Katrina shootings just finished their latest rounds of court battles, they’ve been at it for some 15 YEARS. The unions in some cities aren’t as strong as in others and even in the cities with strong unions the pols will marshal their forces for a major case knowing they can whip a great deal of the public to their side. We also have the POtuS taking a partisan position here and holding out the promise of a DoJ ‘civil rights’ intervention as a next phase of the ongoing persecution.
        The Fed’s fallback plan is always to send in the DoJ with a civil rights suit so that even if the target is found not guilty they’ll be damn near bankrupted. Gotcha one way or another.

        My understanding is that Williams is an activist judge. But even an activist judge with a) any common sense b) any understanding of the law c) any sense of self dignity would have to acquit in this case.

        Judges are some of the most powerful people on earth and with that power comes a certain sense of arrogance. No judge every likes to be overturned. If Williams had found Nero guilty on any count his verdict would have eventually been overturned.

        I read one of the judges lines of questioning (can’t remember the specifics or where I read it 😐) but the gist of the judges question to the defense attorney was something like this “Are you arguing that the defendant ran his nose into the plaintiffs fast moving fist and the defendant is liable for the blood on the sleeve of the defendant’s shirt? Is THAT what you are arguing?”

        Never never piss off a judge or insult his intelligence.

        It was a painful exchange to read.

    Just remembered, forgot to mention it last nite as I was too tired. Yesterday I took the GGS back to his Mom, a 100+ mile round trip. About halfway through I get a call from the Czarina that as she was sitting on the back porch an unknown white pickup truck comes bouncing up our driveway. The BD dog is out and starts barking her head off, the truck stops, decides to back down the driveway and leaves.
    We are rural, we are 8 miles from the closest gas station, 20 miles from a Walmart. Our street is a narrow macadam farm road, it’s dead end about a mile long and we’re 3/4s the way down. To get to us you have to turn up a 900-foot gravel driveway, through an entrance with ‘private property – no trespassing’ signs on either side when, if you’re looking for a place to turn around if you discover you are lost, you could see a clear turn-around just ahead on the macadam road. The turn up our drive was deliberate.
    Dear Progressives, that’s why we have dogs and both of us have ready access to firearms. An uninvited trespasser knowingly trespassing late on a Sunday afternoon could be an accident but could also be an accident waiting to happen, especially when she’s alone (OK, has three very protective dogs). Yes, she could have called the sheriff’s office but response time would have been greater than 20 minutes. That’s still better than in New Orleans where the response time in our district in a like call would have been better than one hour.

      Glad the czarina is OK. I suppose the best way to deter trespassers is a sign that says “Trespassers liable to be tied up and have to listen to czar read the newspaper aloud using puns.”

          Czarina needs a brace of Colts, and a Winchester ’73 at the ready. Sometimes “tourists” drive up my lane, Mr. Colt is slipped in the belt, small of the back, while waiting for the door bell too ring. Dogs are the best early warning scouts around, “it’s their yard, home, and family” they protect!

            She’s really a….laid back….shooter, doesn’t want to be bothered with hand placement, safeties, all that. She does all right with that 2″ S&W and the AR for distance effect. The AR resting against the patio rail is visual enough to make the uninvited uneasy.

      You’d think as far out as we are we wouldn’t have folks coming up, but on occasion they do, usually they’re lost and seem to be too stupid to read, as we have Private Drive down by the dirt road and then all up our drive we have signs a No Trespassing Sign, Trespassers will be Shot, Bullets are too expensive to give a Warning Shot, you get the picture, they are well warned.
      If it’s after dark, they always seem surprised to be met with snarling dogs and snarling owners carrying big guns.
      If it’s daylight, they’re still met with barking dogs, who only snarl if they press the issue and the owners still have a gun, they just don’t know it.

      Those who aren’t selling something or asking for votes usually use the excuse they were lost and thought this was a road. One of us always tell them that failing to read signs is a good way to get shot.

        Agreed, and ditto about meeting them with a gun, they just don’t know it. All three of our dogs have been abandoned 0ut here and one ‘abandoned’ house on the property across he road from us was broken into and used by local dopers as a crash pad. I also ran into a truck coming up my driveway looking to dump a ton of construction debris and those pesky poachers who believe any land not posted (state law says we don’t have to) is open to hunt. Have run into more than one armed trespasser wandering through our land.
        We have had pour share of independent business thugs trying home invasions out here, they generally follow women home and grab them in the driveways or as they enter their homes. Dogs and armed Czar/Czarina are deterrents to that.
        I built that AR for the Czarina and we’re looking at some range time for refamiliarizing. She has two shotguns but recoil’s irritating and it’s a short and easy to handle AR that has about 40$ of the recoil of a regular M4 with almost zero muzzle flip. Comes in handy for deterring all sorts pests and the bullets are lead-free, take that tree huggers.
