Congress Can Deny Barack Obama the Power to Replace Justice Scalia

Indeed, President Obama isn’t even entitled to nominate a replacement for Justice Scalia–or at least, Congress can deny him that right. The Constitution gives Congress the power to decide how many seats there are on the Supreme Court. In 1789, there were only six. Given sufficient congressional support (i.e., veto-proof majorities in both chambers), Congress could reduce the number of Supreme Court justices from the current nine to eight. McConnell, Cruz, and Rubio could propose doing so right now. It seems strange to criticize senators who are merely expressing in what circumstances they will withhold their consent when Congress has the power to deny the president the ability to fill this vacancy entirely by itself eliminating this vacancy.

That would make the lower courts work harder rather than send case and risk getting it kicked back because of a tie.

I think this is very suspicious, because Scalia was an important person in the U.S. Gov. and I can’t imagine there is not something radically wrong that he was pronounced dead by natural causes over the phone, no less. I can’t imagine that there will be no autopsy. And, look how frustrated Obama has been recently because he isn’t getting his way. Judge Scalia was in that way.

He was pronounced dead over the phone, but only after his personal physician called the local judge to discuss the condition of his health. That was a number of hours, according to at least one newspaper account that I read, after he died. Not until at least 8:00 pm. She waited to get that information before deciding.

I always thought myself fortunate that my parents of Italian ancestry left Queens in 1959 and moved to “cow country” (“Upstate New York”). I was born in “the country”. Throughout my life I’ve become close friends with Jewish people and began to notice that fact: Some say that there are similar family dynamics between the two types; also, Ginsburg and Scalia shared roots in two NY Burroughs which were very similar when they were young, but are not today. [I also share(d) with Scalia a preference for Irish partners (lol).]

I did not take the news about Scalia well at all. I don’t recall having this kind of reaction. My first thought was that we had lost a valuable General during a war–and a war of societal, political and cultural supremicism being waged on our soil, from within and on many fronts. I think the proper perspective is that it is 100-years-old.
I was with a friend who said, out of the blue, “Scalia”. I looked at him and said something empty like, “yeah…”. He said with a bit of exasperation, “Now for Thomas.” The idea being that Scalia was a good start. He started to say something about how he particularly despised Thomas and I told him with as much seriousness as I could muster that if he wanted a fight, then go down that road. If we had that fight, it may have ended our friendship–which is based on something very important that is non-political.
Of course, I would have had the same thoughts about Ginsburg or Kennedy–just in case you think I’m being superior–though I would NOT have gloated to him about such a thing.

Oh, hi all!
Been painting, scrubbing, cleaning, patching, sanding, and hauling stuff for three days.
Remodeled the front of the house and got ‘er open this AM after being closed for a week. The restaurant looks gorgeous. New floor, new colors, new lunch counter.
I’m taking today off. I think.

My Nana died a few months ago, and my two aunts just sent me a box of things from the house.
One of them is a little tiny book called The Following of Christ, by Thomas A. Kempis. I thought it was a little bible at first, bound in faux black leather, gilt-edged pages.
Menagerie, ever heard of this book? It’s pretty old, this copy. Printed in 1924 in Belgium.

Damn foreigners!
Calls me and she can’t speak English worth a damn, all I can understand is this Donna, I tell her she has the wrong number and then something about puter owner and I tell her I’m not interested and she calls right back.
Then a little clearer says “why you hang up?” I tell her because I’m not interested in whatever you’re selling or whatever scam you’re running. She says something about not sell you, puter ID. Not interested, do not call here again. She calls right back and says something about not hang up, call again, puter hacked. I tell her if she calls again I’m reporting her number to police. She calls back and again something about not hang up, she mad, ID stolen, listen. I tell her I’ve got police on the other line tracking her number. She hangs up and calls back again, DH answers and says, “I am U.S. government, do you see the drone?” She hung up and hasn’t called back.
So if you get a call from 203-318-0712 just answer and say the drone is outside or on it’s way and you will only have to answer once. lol

They’ve been around for a few years, and you’re not the only one to get called. They call up asking for the person responsible for the computers in the home, telling them they are from Microsoft and that they’ve been hacked. Then they try to get the individual to grant them remote access over the internet to “fix” the problem.

They asked for the wrong person here and they obviously don’t like to be denied.
I looked up the number and apparently if you allow them access to your computer, they get into your online accounts. They want you bank account and credit card numbers. I guess some folks allowed it and then paid the price.
Anytime a person speaking broken English calls me I hang up.

Using caller ID, I don’t answer the telephone unless I recognize the name or number, and I want to speak with the person calling. I do not answer calls from “Private Caller” or “Unknown Name” either.
If the call is important, they will leave a message. If they don’t leave a message, I assume the call was not important.

I’ve been answering strange numbers lately because for a change I’ve kind of been enjoying answering all the polls and there have been a bunch of them.
I kind of find it odd though because when I search for Oklahoma polls I can only find a few.

A good way to deal with calls like this is to say, “please hold”, then put them on hold, or set the receiver down until they hang up.
The best way is just to hang up without saying anything.

Normally when you say they have the wrong number and hang up they don’t call back.
I think this is a first where I had them call back numerous times.
Reading some of the people who has dealt with them though they seem to call over and over again even if you don’t answer and they will leave repeated messages if you let it go to voice mail or answering machine.

It is beautiful here as well, supposed to stay beautiful all week, they’re even claiming 80* Thursday. It’s 60* today with a light wind.
I went out in the pasture and sat in the sun and took pictures of the animals to update our farm page. Then I just sat out there and enjoyed the sun on my face.

Yes, I understand why passwords are universally despised: the strains they put on our memory, the endless demand to update them, their sheer number. I hate them, too. But there is more to passwords than their annoyance. In our authorship of them, in the fact that we construct them so that we (and only we) will remember them, they take on secret lives. Many of our passwords are suffused with pathos, mischief, sometimes even poetry. Often they have rich back stories. A motivational mantra, a swipe at the boss, a hidden shrine to a lost love, an inside joke with ourselves, a defining emotional scar — these keepsake passwords, as I came to call them, are like tchotchkes of our inner lives. They derive from anything: Scripture, horoscopes, nicknames, lyrics, book passages. Like a tattoo on a private part of the body, they tend to be intimate, compact and expressive.

This is just me, but if I was running a charity I would refuse to pay to have someone speak. Presidents should not ask to be paid for speaking at charities, imho.

Just about every article I have read about Justice Scalia’s death mentions that a priest came and gave last rights, properly termed Anointing of the Sick, one of the seven Sacraments of the Catholic Church.
Apparently I wasn’t the only one somewhat taken aback by this anointing after death. For anyone who might be interested, Father Z has a discussion clarifying why this was done and how a priest judges it permissible to anoint. There is discussion by early church theologians and a really intruiging comment from a nurse, as well as commentary from several priests.

He usually tells it very bluntly like it is. Also, he carries guns as well as his priest stuff like stoles and anointing oils in pants with those big cargo pockets. Is a big proponent of men carrying in church for when the crazy feminists or rabid Muslims attack. He ain’t a pacifist, for sure. He’s quite a character.

Quite a few of them now. They have kept their very beautiful liturgies and now have a bishop too I think. Many Anglicans and Episcopalians joined during the papacy of Benedict, after their battles over women and gay priests, among other issues. Benedict did a lot to facilitate the Church welcoming them. It was controversial to their hierarchy though. Some thought he was opportunistic, but I think he was (is) a very holy man, opening a door to those who were standing on the threshold.

Reality often sucks, but it’s better than some made up world where everything is wrong and you view every single action of everyone in the world as an infringement on your rights, where hatred is the fuel you live on. You might burn real bright for a short time, but you are going to burn up and out soon. Hatred can never fuel a productive life.

I’ve posted before about Joey + Rory, her three wishes were to live to see another snowfall, another Christmas and to see her little girl, Indy’s 2nd birthday. Indy’s birthday is Wednesday.
Their new album which is all hymns came out today, I didn’t know there would be a DVD as well, but saw it tonight when I went to Rory’s blog. My husband and daughter are huge fans and both have wanted the CD so I ordered both of them the DVD/CD.
Listening to these old songs bring back so many memories. My earliest memories are Saturday nights, my family sitting around the living room, my Dad playing the guitar and all of us singing old gospel songs with a few Hank Williams songs mixed in there. 🙂 Dad loved him some Hank Williams and he was providing the tunes. lol The night always started and ended though with “I’ll Fly Away,” the very first song I learned by heart and still one of the few songs today I can sing all the words without having to think of all the words.

Sled dog update. {deep sigh} The Yukon Quest ended as expected. Hugh Neff won, Brent Sass was second and Allen Moore was third. They all ran good races. Many teams are still on the trail, and the Red Lantern still has 325 miles to the finish. Good luck to him, and all the teams still racing. And congratulations to Hugh. Well done.

I thought W was supposed to be throwing Jeb a lifeline. Reminding folks the Bush family are establishment and proud of it doesn’t seem like much of a lifeline and instead sounds like he threw him a rope with a brick tied to it.
