      I don’t know anything about this case but I tend to agree with the defense attorneys on the face value of their argument.

      Defense attorneys argue the SUV driver who actually struck the police officer should have been charged.

      I don’t know the sequence of events that led to the officers death but it seems that unless it happened immediately as an unavoidable reaction by the SUV driver to the collision event of which he was a non fault party, then the SUV driver had the legal responsibility to drive safely under the conditions of passing by, or driving though, a crash scene.

      Is the SUV drivers last name Clinton?

        More info. I don’t know a lot about this either, but with him having been leaning on the guardrail, I am not sure how he was charged. The man that hit the officer was given immunity to testify at trial. Still looking for his name.

        I think it is an interesting case but legally flawed. I think the prosecutor wants to get “homicide waiting to happen” James Ryan off the street and is doing some fancy footwork.

        The two cases the prosecutor invokes as precedent are not really in the same “causation/foreseeability” club. In the 1994 case it is easily argued that the officers pursuit of a criminal was the direct cause of the officers death and no third party was involved. In the 2013 case the drunk driver created what was likely argued in court an unavoidable road hazard for someone obeying the rules of the road.

        Two cases of sketchy precedent, one in 1994 pfftt…

        True the prosecutor should and will argue successfully “causation/foreseeability that bad things could happen if Ryan started drinking.

        Officer Olivieri was the first responder. Did he have his flashing lights on alerting motorists to the road hazard? I would guess yes, because it is a reasonable thing to believe and if Olivieri did not it would be stated by the defense.

        So the SUV driver failed to take proper cautionary steps under hazardous road conditions. I lean toward the judge who ruled that the death of Olivieri is “solely attributable” to the SUV driver.

        Although I agree with the solely attributable cause of death I believe there is a grey area which does allow for some criminal causality to be attributed to Ryan, as it is Ryan’s criminal conduct which ultimately set into motion the effect that killed Olivieri.

        The prosecutor would do better to go for and get easy convictions with consecutive sentences on Ryan’s indefensible legal offenses.

        My guess is that it is a prosecutorial overplay in hopes of making sure that the jury is aware of the deadly consequences of the doe eyed, well cleaned up young man, sitting before them. Perhaps the information about Officer Olivieri would not be admissible without the charge.

    I just got bounced from the Facebook Ace O’Spades Moron Lifestyles group. Some guy called Trump a Trumpanzee, I called him on it, he said I went after him personally, and he had me bounced. If anything interesting happens there, let me know. Otherwise, I don’t care.

          In addition to the NFL cheerleader threads, he also has book threads (with pics of really amazing libraries) and art threads every day, with amazing paintings that no living painter could do today, unless they somehow managed to skip out on postmodern no-more-beauty-in-art indoctrination. Ace has a new amazing painting pretty much every day.

          Look, I gotta defend these folks. They love them some vulgarity — so did Mark Twain, the genius. They also love them some beauty and truth. It’s like most bikers I’ve known. Good, but a bit rough.

    Not sure where to post this, amidst all the exchanges above, but sorry you got in that one’s “sights” .

    People have ranted and raved on the internet forever. That’s the nature of being able to say what you think without someone punching you in the nose or stalking your house; because it’s virtually anonymous, and you don’t have to observe the niceties of civilized speech and manners.

    HOWEVER, I have noticed a big increase in the scope and frequency of nastiness lately. A lot of it is tinged with barely-disguised undercurrents of desperation, distrust, and despair.

    Someone/something turned up the fire underneath everything. We’re basically at boiling point. Where to from here? That’s the big question.

        My FB friends list who has always mainly consisted of family members just keeps getting smaller. I rid myself of most of the liberals and now I’ve been doing the same with others.

        I mainly do FB to keep in touch with family members I like across the country and for farm sale groups.

        I still get drug into the craziness sometimes because some of them won’t whittle down their lists.

        There is a reason why I say I prefer the company of my animals to people, heck even the pigs are better company. 🙂

          I honestly don’t know. Because I don’t know single thing about how that place works. Heck, I didn’t even have a MySpace account.

          But isn’t this a community? We don’t need to “follow” each other or “friend” each other. We just need to scroll-wheel down and READ each other.

          I posit that this and CTH are far better than FB, For so many reasons. All of which are related to the concept of Truth.

          Unless Stella is actually Mark Zuckerberg’s auntie.

            I never had my space either and held out forever on FB, but family members kept asking me if I saw this family member or that family member’s picture of their kids, grandkids or old pictures of family that so and so posted.
            My kids had me a FB account that I never got on and probably wouldn’t have if it wasn’t for all the family. It is also good for advertisement for our business and our farm.

            I hate the people who run it, but it’s not all bad.

            I know lots of people who use FB for a variety of reasons. I don’t have a problem with it. I choose not to use it only because my family doesn’t and I just have no need. But the ones I know who do use it enjoy it and if arguments arise they can just do whatever peeps do on FB. Unfriend?

            They have needle teeth or some call them eye teeth. The old farmer’s tale is that if you clip them then they won’t grow out of their mouth when they get old. Another reason to do it though is they will often cut the sow’s teats all to heck if you don’t clip them. Not always will they do that, but if they do then she will start not letting them nurse.

          I told my dad a few years ago, when we both discovered that we both read a lot of the same sites for news, that I try to be both respectable and respectful when I comment.

          If I’m ever short of that goal, it’s because I momentarily forgot that he’s reading these, or that I should always be posting comments as if he is.

          Sometimes I fall short of that goal. But it’s the goal.

    On a lighter note. Today I was part of a meeting, I was there solely to offer insight. Anyhow there is a rude women who always says, “I hate to ask a stupid question, but….” The but is always followed by an insult about something someone has said or done, and then she suggests how to improve the person or the thing being done.

    It usually goes something like this, “I hate to ask a stupid question but is your choice of font really any different than Charles Manson would choose? I mean look at the font that I use, it really is beautiful, so it’s settled then?”

    Anyhow the woman starts with, “I hate to ask a stupid question.” And my favorite person in the room says “But it has never stopped you before.”

    I really tried not to laugh but I did. The meeting proceeded without her asking her question and without her saying, “I hate to ask a stupid question” again.

      I’m probably still employed and alive because I don’t.

      I usually think of the funniest thing to say about 20 minutes later.

      A dude at the gas station where I buy my smokes says “assalamualaikum” to me.

      I just said “What up, man?” or something.

      20 minutes later I thought, “I should have responded quickly with ‘Shalom’.”

      I’m still alive, thanks to my slow wit.
