6 Reasons DOJ’s ‘Get Trump’ Documents Case Is Seriously Flawed

The author of this editorial is Will Scharf, a former federal prosecutor, who also worked on the confirmations of Supreme Court Justices Brett Kavanaugh and Amy Coney Barrett., and clerked for two federal appellate judges. He is currently a Republican candidate for Missouri Attorney General.

I have reviewed the indictment brought by Special Counsel Jack Smith in the documents case against former President Donald Trump, and have serious concerns with the way this case is being framed in the public and with some aspects of the way the prosecution itself is being conducted.

Here are six major issues I see that need to be addressed by the special counsel’s team.

1. Interplay Between the Espionage Act and the Presidential Records Act

Others have already spoken insightfully about the scope of the Presidential Records Act (PRA). Mike Davis of the Article III Project has published and spoken on the subject, and Michael Bekesha of Judicial Watch had a fascinating article in The Wall Street Journal detailing his experience litigating the Clinton Sock Drawer Case.

Basically, their argument distills down to the idea that the president’s authority to retain personal records, as well as his rights to access his presidential records, make it impossible to prosecute him under the Espionage Act section at issue here, § 793(e), because the government cannot prove “unauthorized possession,” as required under the statute.

Ernie Harwell’s Definition of Baseball

Ernie Harwell was a true gentleman. An old-school gentleman who wasn’t afraid to show emotion and talk about how much he cared about his marriage and his wife. We were lucky to have him as the announcer for the Detroit Tigers for 42 seasons, and then as an occasional commentator after his retirement. He passed on in 2010, with his wife of 68 years, his beloved Lulu, and his four children at his bedside. His bronze statue graces the Detroit stadium where the Tigers now play.

The Perfect Classic Turkey Club Sandwich

Just watched this video, and I am filled with envy for something I can’t eat right now while following a low-carb diet: really good bread. This bread is one that I was making on a regular basis just two short months ago!

Anyhoo, that sandwich sauce looks really delicious, and the sandwich is definitely worth the time and effort. Glad that I just ate!

PS: I promise to post about some delicious low-carb foods sometime soon. In the meantime, you COULD make this sandwich with a keto wrap or some other low carb bread. I just saw a recipe for keto English muffins that looks promising. No wheat, so it would work for a gluten-free diet as well.  I’ll let you know if I try it.
