The Bayh-Dole Act, also known as Patent and Trademark Law Amendments Act, was adopted in 1980 by Senators Birch Bayh of Indiana and Bob Dole of Kansas. The Act allows contractors to own inventions arising from federal government-funded research, allowing universities, businesses, and non-profit organizations to pursue ownership of an invention instead of assigning them to the federal government.1 The term “invention” refers to any invention or discovery that is patentable or protectable under the U.S.C. Title 35.
