A woman named Hoda Muthana who formerly lived in Alabama, and who joined ISIS, now wants to return home with the 18-month-old son she had with her ISIS husband. She will not be admitted back into the United States.
We have discussed this case a bit, and lovely provided some background this morning. It seems that there is confusion over the reason why she is not a citizen of the United States. Mike Pompeo says no, and this is why.
All together now: gee, that’s too damn bad. Although apologists for Muthana, such as NPR, the Council on American-Islamic Relations, and the New York Times refer to her as if she were a real American, in fact — as the child of a diplomat who just so happened to have been born here — she’s not.
Mr. Pompeo issued a statement declaring that she “is not a U.S. citizen and will not be admitted into the United States.” Mr. Pompeo said Ms. Muthana did not have “any legal basis, no valid U.S. passport, no right to a passport, nor any visa to travel to the United States.”
Mr. Pompeo’s statement did not offer a rationale for why the State Department does not consider Ms. Muthana a citizen. But American officials seem to be hinging their argument against allowing her back in on an exception in the law. Ms. Muthana’s father was a Yemeni diplomat, and children born in the United States to active diplomats are not bestowed birthright citizenship, since diplomats are under the jurisdiction of their home countries.

Saying no to these two women may seem cruel (although not as cruel as ISIS fighters sawing off heads and burning captives alive). But there are times when it’s even crueler to be kind, and this is one of them. Until Islam learns it is not entitled to its stealth takeover of the West through a combination of terror and lawfare — and that it’s not “jingoistic” for us to fight back by any means necessary (to use one of the Left’s favorite phrases) — we’re going to have cases like these. The time to draw the line is now.
This woman was of legal age when she decided to sneak into Syria and join Isis. She was married to THREE different Jihadi men (the first two were killed), so it seems that she was pretty confirmed in her choice to join the bad guys. Now, four years later, because her guys lost and she is with the Kurds in a refugee camp, she wants to return to the good old USA, where it is safe and warm. She says she’s sorry? I’m not convinced.
Only four years ago, she wrote this:
“Americans wake up! Men and women altogether. You have much to do while you live under our greatest enemy, enough of your sleeping! Go on drivebys, and spill all of their blood, or rent a big truck and drive all over them. Veterans, Patriots, Memorial, etc day … Kill them.”
The citizenship clause (section 1) of the 14th Amendment to the United States Constitution:
All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
The exception to the 14th amendment’s citizenship clause is this: Children born to foreign diplomats are not “subject to the jurisdiction” of the United States and are therefore not to be granted U.S. citizenship.
Listened to the CAIR apologist yesterday, who is “representing” jihadi jane. The CAIR guy claims jihadi jane’s father had ceased being the Yemen diplomat one month prior to jihadi jane’s birth. Others have said it was several months before jihadi jane’s birth.
Whichever is true, jihadi jane’s father was apparently here illegally, which would make jihadi jane an American.
Judge Nap, Fox, says it is impossible to strip an American of his citizenship. ?????
Looks like we shall need to convict jihadi jane of treason, and proceed with jihadi jane’s execution.

I’d feel a little more like letting her come ‘home’ and be tried in a military tribunal as an enemy combatant IF she’d have had this sudden change of heart BEFORE US, Russian and Turkish military power ground ISIS into hummus…or is that humus? Either way…
Maybe we could compromise and bring her back to American soil at Gitmo? Yeah, she wants to come back then send her to Gitmo for afew years of pretrial confinement while they…interrogate…her for that vital information she has. Alternate is to release, in Arabic, the recordings of her volunteering to spill the beans on ISIS and put her up in a hotel in the Middle Euphrates River Valley rec area while her request’s being pondered.

Absolutely a prime Gitmo candidate. Try her for treason in a court set up there, win the case overwhelmingly, and videotape her public execution.

The thing hinges on the status of her parents when she was born BUT even if the courts decide she is a citizen there’s a host of laws that can be used to nail her…and if the DoJ plays pattycake I hope Trump nails them on it. Let the next Rat president pardon her.
Let’s hope her reward in Jannah is 72 Pee Wee Hermans. Unless incidents in peep shows reflect upon one’s virginity.

Her parents’ lawyer, Charlie Swift, says he has represented 1 muslim who has been tried and got off, but there have been 176 who didn’t get off.

There’s a whole volume of reasons her citizenship could be revoked, if she ever even had it, but the obstacle is the army of pantywaist prog apologists in State and DoJ who never met a threat to America they didn’t embrace.

Just read this at NBC News:
The Obama administration was first to determine she was not a citizen and notified her family they would revoke her passport in January 2016.

Apparently her passport was issued to her in error (the state probably issued a birth certificate when they should not have done so (that would be New Jersey.)

It appears to me that since diplomats children born here are not to be considered citizens, I don’t think that the 14’th Amendment ever intended to allow illegals children to be citizens.

If the gutless let her come back the POTUS and AG should have DoJ gin up that huge list of crimes parsed from US law as they do with anyone else they want to use to count coup (pun really not intended but accepted). About 60 years in a Fed prison should do it, parole should be based on when the ISIS experience becomes a sitcom basis, sorta like how Hogan’s Heroes’ did WWII.

Same as they do with children of other families who have caregivers in jail – she has family. This isn’t shoplifting, she was openly advocating the active murder of American citizens and supporting the deaths of people in Syria.

Ahhh…same answer, send him to her parents. Even if they’re here he can get a green card and can apply for citizenship at a later date…if he learns to speak Spanish.
I’m not necessarily a fan of letting the kids supper from the sins of their parents but then I’m not a fan of using the child as a roadblock to her just desserts.

Even now Muthana is not renouncing Islam only the “extremist Islam” in which she has participated actively and zealously in for the past 4 years.
Among the other things we have learned of Muthana she also cheered the Charlie Hebdo massacre.
Perhaps it is stated somewhere but it I can’t find it but it appears that her family here, her birth family is a Muslim. Hmmm…why is the MSM making this difficult to find the answer to?

Growing up in Hoover, Alabama, a prosperous suburb of Birmingham with a sizable Muslim community, Muthana was raised by strict Yemeni immigrant parents who forbade her from owning a smartphone — ubiquitous among US teenagers — until she finished high school.
The phone opened her world. “I’m just a normal human being who has been manipulated once and hopefully never again,” she said.

She has the command to use taqiyya down pat. There is no way to disown violent jihadi Islam because that IS Islam. She says she will fight against that interpretation. Laughable! There is no other interpretation. It’s all in black and white. What’s in the religion’s documents is what counts.

If that’s true then he should be deported. Of course that leaves the birthright bs that really needs to be fixed/clarified. IMO I don’t think the Constitution gives someone born to an illegal citizenship, but I don’t get to make the call.
